Terms of Service

These Terms of Service ("Terms") govern your access to and use of Airdraft Cloud ("the Service"), operated by Aevr ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@useairdraft.com if you believe your account has been compromised.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Upload or distribute malware, viruses, or any harmful code.
• Attempt to gain unauthorised access to the Service or other users' accounts.
• Use the Service to send unsolicited communications (spam).
• Reverse-engineer, decompile, or otherwise attempt to derive source code from the Service.
• Resell or sublicense access to the Service without our written permission.

4. Your Content

You retain ownership of all content you create and manage through the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive licence to host, store, and transmit Your Content solely to provide the Service.

You are solely responsible for Your Content and represent that you have all necessary rights to upload and publish it.

5. GitHub Integration

The Service integrates with GitHub via a GitHub App. By connecting a repository, you authorise us to read and write files within the scope you grant. You are responsible for managing the GitHub App installation and the permissions granted.

We are not responsible for any content, commits, or changes made directly to your repository outside of the Service.

6. Subscription and Billing

Access to certain features requires a paid subscription. Prices are displayed in the dashboard at the time of purchase.

• Subscriptions renew automatically unless cancelled before the renewal date.
• Refunds are issued at our discretion. Contact us within 14 days of a charge if you believe it was made in error.
• We may change pricing with 30 days' notice. Continued use after the change takes effect constitutes acceptance.

7. Intellectual Property

The Service, including its design, code, and documentation, is owned by Aevr and protected by intellectual property laws. These Terms do not grant you any rights in the Service's intellectual property beyond the limited licence to use it.

8. Availability

We aim for high availability but do not guarantee uninterrupted access. We may suspend or discontinue the Service or any feature at any time, with reasonable notice where practicable.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from your account settings. Upon termination, your right to use the Service ends immediately.

Your content committed to GitHub repositories is not affected by account termination.

10. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, Aevr shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the dashboard. Continued use of the Service after changes take effect constitutes your acceptance.
